IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY BEFORE DOWNLOADING, INSTALLING, ACCESSING, PLAYING, TESTING, OR USING NACHODAYS.

By downloading, installing, accessing, playing, testing, creating an account for, signing into, interacting with, or otherwise using Nachodays, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not download, install, access, play, test, or use Nachodays. If you are under the age of 18, your parent or legal guardian must review and agree to these Terms on your behalf before you use the Game.

1.1. Preamble

Welcome to Nachodays, a free-to-play strategy, card-battle, action adventure, platformer, collectible, online-enabled video game developed by an independent creator. These Terms of Service, referred to as the “Terms,” “Terms of Service,” or “Agreement,” form a legally binding agreement between you, the user of the Game, and the Developer of Nachodays.

These Terms govern your access to and use of Nachodays, including but not limited to the Game application, online features, account systems, anonymous or persistent sign-in systems, virtual items, reward systems, progression systems, social systems, Churches, Church chats, Church message boards, advertisements, optional paid features, Premium Program features, websites, legal pages, support pages, updates, downloadable content, beta builds, testing builds, open testing builds, and any other related service, feature, content, or system connected to Nachodays.

By using Nachodays, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, you must immediately stop using Nachodays and may not access the Game or its related services.

1.2. Age Requirement and Legal Capacity

Nachodays is intended only for users who are at least 13 years of age. By accessing or using Nachodays, you represent and warrant that you are at least 13 years old.

If you are under the age of 18, you represent and warrant that your parent or legal guardian has reviewed these Terms, understands them, and agrees to them on your behalf. Your parent or legal guardian is responsible for your use of Nachodays, including your account activity, purchases, communication, conduct, and compliance with these Terms.

Nachodays is not intended for children under 13. The Game may contain themes, story content, emotional subject matter, fictional conflict, fantasy violence, or narrative material that is not intended for younger audiences. Users under 13 may not use Nachodays.

If the Developer discovers or reasonably believes that a user is under 13, the Developer may suspend, restrict, delete, or terminate the account and associated data, subject to applicable law and the Privacy Policy.

1.3. Legal Capacity and Authority

By accepting these Terms, you confirm that you have the legal capacity and authority to enter into this Agreement. If you are accepting these Terms on behalf of a minor, you confirm that you are the parent or legal guardian of that minor and have the authority to accept these Terms on their behalf.

You may not use Nachodays if you are prohibited from doing so under applicable law, platform rules, court order, prior account restriction, prior ban, or any other legal, contractual, platform-based, or technical restriction.

1.4. Definitions

For purposes of these Terms:

“Nachodays,” “Game,” or “Service” refers to the application known as Nachodays, including all versions, builds, test builds, beta builds, open testing builds, future releases, updates, features, systems, online services, websites, support pages, assets, account systems, and related materials.

“Developer” refers to the independent creator, owner, operator, and rightful intellectual property holder of Nachodays, unless otherwise stated.

“User,” “you,” or “your” refers to any person who downloads, installs, accesses, plays, tests, views, interacts with, creates an account for, or otherwise uses Nachodays.

“Content” refers to all materials, elements, and intellectual property included in or related to Nachodays, including but not limited to artwork, sprites, illustrations, animations, rigs, models, textures, icons, characters, Champions, names, titles, lore, dialogue, story content, scripts, source code, object code, music, sound effects, UI/UX design, game systems, data structures, databases, reward structures, balance systems, visual effects, logos, branding, websites, text, documentation, and promotional materials.

“Virtual Items” refers to all in-game items, currencies, rewards, pulls, titles, Champions, cosmetics, upgrades, credits, vouchers, boosts, benefits, event rewards, unlocks, progression markers, or similar digital items or benefits, whether earned, granted, purchased, rewarded through advertisements, provided through promotions, or otherwise obtained.

“Account” refers to any guest, anonymous, persistent, email-linked, platform-linked, or other user profile used to access Nachodays or store gameplay data.

“Church” refers only to an in-game player group, club, fellowship, guild, community group, or social feature within Nachodays. It does not refer to any real-world religious institution, real-world church, denomination, legal religious entity, place of worship, or real-world religious organization.

“User Content” refers to text, names, messages, posts, reports, Church names, Church descriptions, Church announcements, player names, profile text, or other content submitted, entered, posted, transmitted, or provided by users through Nachodays.

“Premium Program” refers to any optional paid membership, subscription, recurring access feature, ad-replacement feature, ad-skip feature, paid pass, or similar monetized program offered by Nachodays.

“Advertisements” or “Ads” refers to rewarded ads, optional ads, interstitial ads, ad-supported features, third-party advertisements, sponsorship placements, or advertisement-based gameplay boosts or rewards.

1.5. Acceptance, Continued Use, and Updates

Your use of Nachodays constitutes acceptance of these Terms. The Developer may require you to accept these Terms through an in-game prompt, website link, button, checkbox, account creation flow, update notice, app-store listing, or other reasonable method.

The Developer may update these Terms from time to time. If a new version of these Terms is released, the Developer may require you to review and accept the updated Terms before continuing to use Nachodays. If you do not agree to updated Terms, you must stop using the Game.

Continued use of Nachodays after updated Terms are made available may constitute acceptance of the updated Terms, subject to applicable law and platform requirements.

2.1. Intellectual Property Ownership

All Content in Nachodays is owned by the Developer or used by the Developer under license, permission, contract, or applicable law. This includes, without limitation, all art, sound, characters, story, lore, names, logos, branding, animations, code, systems, music, UI, gameplay rules, worlds, visual designs, written materials, and all other creative or technical elements of the Game.

Except for the limited license expressly granted to you in these Terms, you receive no ownership rights, title, interest, copyright, trademark rights, trade dress rights, patent rights, database rights, moral rights, publicity rights, or any other rights in or to Nachodays or its Content.

All rights not expressly granted to you are reserved by the Developer.

2.2. Limited License to Use the Game

Subject to your compliance with these Terms, the Developer grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, access, and use Nachodays for personal, non-commercial entertainment purposes only.

This license does not allow you to copy, sell, rent, lease, distribute, sublicense, modify, translate, adapt, reverse engineer, extract, scrape, train AI on, publicly display, publicly perform, commercially exploit, or create derivative works based on Nachodays or its Content.

The Developer may revoke this license at any time if you violate these Terms or if continued access is no longer possible, lawful, safe, technically feasible, or commercially reasonable.

2.3. Prohibited Use of Game Content

You may not, without prior written permission from the Developer:

Reproduce, copy, distribute, upload, sell, rent, license, sublicense, host, mirror, or redistribute any part of Nachodays or its Content;

Extract, rip, dump, download, decompile, export, or otherwise obtain Game assets, sprites, music, sound effects, animations, code, UI, fonts, databases, configuration files, reward data, or other Game materials;

Use Nachodays Content in another game, app, website, video, product, service, advertisement, marketplace listing, mod, fan game, NFT, token, collectible, merchandise, dataset, AI model, or commercial project;

Create unauthorized translations, localizations, fan patches, ports, copies, clones, remakes, recreations, or derivative versions of Nachodays;

Use Nachodays characters, names, logos, icons, artwork, music, lore, branding, or worldbuilding in a way that suggests endorsement, sponsorship, partnership, official status, or ownership;

Misrepresent yourself as the Developer, a staff member, moderator, partner, contractor, publisher, rights-holder, platform representative, or official representative of Nachodays;

Use Nachodays Content for any unlawful, misleading, harmful, defamatory, abusive, exploitative, or commercial purpose.

2.4. Screenshots, Videos, Commentary, and Personal Sharing

The Developer may allow users to share gameplay screenshots, gameplay recordings, commentary, reviews, streams, social media posts, and similar personal or community content, provided that such use is lawful, non-deceptive, non-commercial or ordinary creator/community use, and does not violate these Terms.

This permission does not allow users to claim ownership over Nachodays Content, sell extracted assets, redistribute Game files, create competing products, misrepresent official endorsement, upload raw asset packs, train AI systems, or use Game Content in a way that harms the Game, the Developer, or other users.

The Developer may revoke or limit this permission at any time for specific users, types of content, platforms, or uses.

2.5. Prohibited Data Use, Scraping, and AI Restrictions

You may not use any part of Nachodays, including but not limited to assets, gameplay data, dialogue, story text, metadata, screenshots, videos, character designs, music, user data, public pages, website content, databases, or in-game systems, for any of the following purposes:

Training, fine-tuning, testing, validating, improving, or developing artificial intelligence systems, machine learning models, generative models, language models, computer vision systems, neural networks, recommendation systems, or automated content-generation tools;

Creating, expanding, or maintaining datasets, data libraries, embeddings, vector databases, training corpora, model weights, synthetic data, or scraped archives;

Scraping, crawling, harvesting, indexing, mirroring, copying, bulk downloading, extracting, or automatically collecting Game Content or user-related data;

Deriving, simulating, imitating, cloning, reproducing, remixing, or generating Nachodays-style assets, characters, dialogue, music, lore, UI, gameplay systems, or other Content through automated tools;

Using Nachodays Content to develop competing products, derivative works, automated services, AI outputs, imitation games, asset packs, unauthorized translations, or commercial materials.

This restriction applies universally, including personal, educational, academic, research, nonprofit, commercial, internal, experimental, archival, and private uses.

2.6. Enforcement of Intellectual Property Rights

The Developer reserves the right to enforce intellectual property rights through any lawful means, including takedown notices, copyright complaints, platform reports, cease-and-desist notices, account termination, evidence preservation, legal claims, damages, injunctive relief, and other remedies available under law.

Violations of this section may result in immediate revocation of all rights granted under these Terms.

3.1. Account Requirements

Nachodays may allow access through a guest account, anonymous account, persistent account, email/password account, platform-linked account, or other authentication method. The available account methods may change over time.

You are responsible for maintaining the confidentiality and security of your login credentials, device access, email account, platform account, and any other method used to access Nachodays.

You may not:

Impersonate another person;

Use false, deceptive, offensive, or misleading account details;

Share, sell, rent, transfer, trade, lend, or give away your account;

Access accounts you do not own or are not authorized to access;

Use another person’s account to bypass restrictions, bans, mutes, purchase limits, cooldowns, or enforcement actions;

Use bots, scripts, unauthorized tools, modified clients, or other methods to manipulate account data or gameplay systems.

3.2. Account Accuracy and User Responsibility

You are responsible for all activity that occurs under your account, whether or not you personally authorized the activity, unless caused solely by the Developer’s proven misconduct or as otherwise required by law.

You agree to notify the Developer if you become aware of unauthorized access, account theft, suspicious activity, data manipulation, or security concerns related to your account.

The Developer is not responsible for losses caused by weak passwords, shared credentials, compromised devices, unauthorized account sharing, phishing, user error, or failure to protect login information.

3.3. Data Collection and Privacy

Nachodays may collect, store, process, or transmit certain data as described in the Privacy Policy. This may include, depending on the features used, your chosen gamer tag, account email if signed in, user identifiers, anonymous identifiers, player ID, account UID/UIN, reward history, inventory, progression, virtual currency, equipped profile items, tutorial completion, acceptance of legal documents, online match data, Church membership, Church messages, reports, moderation records, purchase status, advertisement-related events, analytics, crash data, device or app version information, and other data necessary to operate the Game.

The Privacy Policy provides additional details about what data is collected, how it is used, how it is stored, how it may be shared, and how users may request deletion or exercise applicable rights.

By using Nachodays, you also agree to the Privacy Policy.

3.4. Data Accuracy and Storage

The Developer may store game-related data on local devices, Firebase, Google Cloud, platform services, or other authorized systems. Some data may be stored locally on your device, while other data may be stored online to provide account access, progression, security, moderation, analytics, online features, and service continuity.

The Developer does not guarantee that local data, cloud data, account data, progression, rewards, settings, or other stored information will always be available, accurate, recoverable, or free from corruption, interruption, technical error, user error, or platform-related failure.

3.5. Deletion and Account Termination

Users may request or perform permanent deletion of their account through available in-game settings or supported account deletion methods. Account deletion is intended to be permanent and irreversible. Deleted account data, including login-linked data, user identifiers, reward inventory, progression, virtual items, and account history, may be permanently erased from the Developer’s active systems and may not be recoverable.

Some limited records may be retained where required or permitted by law, platform rules, fraud prevention, chargeback handling, security, abuse prevention, legal enforcement, backup systems, or legitimate business purposes, as described in the Privacy Policy.

The Developer reserves the right to suspend, restrict, or terminate accounts that violate these Terms.

3.6. Virtual Currency and Virtual Item Ownership

Nachodays may include virtual currencies, rewards, pulls, titles, Champions, cosmetics, vouchers, credits, boosts, access privileges, and other Virtual Items.

Virtual Items:

Have no real-world monetary value;

Are not legal tender;

Are not property owned by the user;

Cannot be sold, traded, exchanged, rented, transferred, gifted, inherited, redeemed for money, or used outside Nachodays unless expressly allowed by an official in-game feature;

Are licensed, not sold;

May be modified, removed, reset, revoked, rebalanced, limited, or discontinued by the Developer;

May be lost if your account is deleted, suspended, terminated, corrupted, or otherwise restricted.

You receive only a limited, revocable, non-transferable, non-sublicensable license to use Virtual Items inside Nachodays while the Game and your account remain available and in good standing.

3.7. No Refunds or Compensation for Virtual Items

Except where required by applicable law or platform policy, users are not entitled to refunds, compensation, credits, replacement items, damages, or reimbursement for lost, modified, removed, expired, unused, rebalanced, discontinued, or inaccessible Virtual Items, whether obtained through gameplay, advertisement viewing, promotional grants, purchases, subscriptions, events, bugs, or other methods.

4.1. Acceptable Behavior

You agree to behave respectfully, lawfully, and responsibly while using Nachodays and interacting with its features, systems, and community.

You may not engage in conduct that includes, encourages, enables, or involves:

Harassment, bullying, stalking, threats, intimidation, targeted abuse, or humiliation;

Hate speech, slurs, discriminatory harassment, or attacks against protected or personal characteristics;

Sexual content, sexual solicitation, predatory behavior, grooming, or attempts to exploit minors or other users;

Graphic violence, real-world threats, self-harm encouragement, dangerous instructions, or illegal conduct;

Scams, fraud, phishing, impersonation, deception, or attempts to steal accounts or personal information;

Offensive, obscene, hateful, disruptive, misleading, or inappropriate usernames, Church names, posts, or messages;

Attempts to impersonate the Developer, moderators, platform staff, law enforcement, other players, celebrities, companies, or official representatives;

Spam, flooding, link abuse, advertisement abuse, or disruptive behavior;

Attempts to evade moderation, bans, mutes, cooldowns, restrictions, or platform rules.

4.2. Cheating and Exploits

Use of cheats, hacks, unauthorized software, modified clients, memory editors, packet editors, bots, scripts, macros, automation tools, emulators used for abuse, database manipulation, API manipulation, fake requests, spoofed responses, or any other method of interfering with Nachodays is strictly prohibited.

Any such activity may result in immediate account suspension, permanent ban, removal of rewards, rollback of progress, reporting to platform providers, reporting to service providers, legal action, or other enforcement measures.

4.3. Bug Reporting and Fair Use

If you discover a glitch, exploit, unintended behavior, security issue, database issue, reward duplication issue, economy issue, online match issue, or other abnormal behavior, you agree to report it to the Developer instead of abusing it.

Users who exploit, share, hide, sell, demonstrate, or encourage abuse of bugs or vulnerabilities may be treated the same as cheaters, even if the bug was caused by an error in the Game.

4.4. No Interference with the Service

You may not interfere with, disrupt, overload, attack, reverse engineer, probe, scan, stress-test, exploit, or attempt to gain unauthorized access to Nachodays, Firebase, Google Cloud, platform services, APIs, databases, authentication systems, payment systems, advertisement systems, account systems, online match systems, or any other technical system connected to the Game.

5.1. No Guarantees of Service

Nachodays is provided “as is” and “as available.” While the Developer may attempt to provide uptime, updates, fixes, improvements, backups, moderation, support, and a stable experience, the Developer makes no guarantee that the Game will be error-free, uninterrupted, secure, available, compatible, complete, or free from data loss.

The Game may be unavailable due to maintenance, outages, third-party service failures, internet issues, device limitations, platform rules, bugs, discontinued services, account problems, legal obligations, security concerns, or other reasons.

5.2. No Warranties or Representations

To the fullest extent permitted by applicable law, the Developer disclaims all warranties and representations, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, uninterrupted operation, compatibility, and freedom from errors or harmful components.

5.3. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including but not limited to loss of data, loss of account access, loss of progression, loss of Virtual Items, loss of enjoyment, device problems, software conflicts, business losses, reputational harm, user disputes, service interruptions, or damages arising from use or inability to use Nachodays.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.

5.4. We Are Not Responsible For

The Developer is not responsible for:

Losses or damages due to gameplay, bugs, balance changes, data corruption, account deletion, account termination, moderation, or service interruptions;

Real-world consequences from in-game actions, user disputes, Church disputes, messages, posts, or interactions between players;

Malfunctions caused by third-party software, user hardware, operating systems, platform services, device limitations, outdated app versions, network issues, or internet connectivity problems;

Issues resulting from a user failing to secure their login credentials, device, email account, platform account, or personal information;

Actions of other users, advertisers, platforms, ad networks, payment processors, hosting providers, or third-party services;

Losses caused by violation of these Terms.

5.5. Some Rights May Not Apply

Some jurisdictions do not allow certain exclusions, warranty disclaimers, or limitations of liability. In such jurisdictions, these disclaimers and limitations apply only to the maximum extent permitted by law.

The Developer does not intend to override rights that cannot legally be waived.

6.1. Voluntary Account Deletion

Users may delete their account through the in-game Settings menu or other supported account deletion process. This process is intended to be irreversible. Associated data, progression, rewards, account history, and other account-linked information may be permanently removed and may not be recoverable.

Before deleting your account, you are responsible for understanding that deletion may remove all access to account data, Virtual Items, Premium status connected to the account, progression, online identity, Church memberships, and other Game-related information.

6.2. Forced Suspension or Termination

The Developer reserves the right to suspend, restrict, delete, terminate, disable, or otherwise limit any account, with or without notice, if the Developer determines or reasonably suspects that:

You violated these Terms;

You violated the Code of Conduct or Community Rules;

You cheated, exploited, hacked, manipulated, automated, or abused the Game;

You harassed, threatened, scammed, impersonated, or harmed other users;

You interfered with game integrity, moderation, payment systems, advertisement systems, online systems, or data systems;

Your account is connected to fraud, chargeback abuse, payment abuse, or suspicious activity;

Your account is inactive for an extended period as defined by internal policy;

Termination or restriction is necessary to protect Nachodays, the Developer, other users, platform compliance, legal compliance, or service stability.

6.3. No Refunds for Account Actions

Account deletion, suspension, restriction, termination, bans, mutes, moderation actions, or loss of access do not entitle users to refunds, reimbursement, replacement, credit, compensation, restoration, damages, or special treatment for any content, progress, virtual currency, premium benefit, paid or unpaid feature, advertisement-based reward, or other account-related value, except where required by applicable law or platform policy.

6.4. Account Appeals

The Developer may, but is not required to, provide an appeal process for account suspensions, bans, mutes, or moderation actions. Submission of an appeal does not guarantee review, reversal, compensation, explanation, or restoration.

The Developer may deny, ignore, close, or limit appeals that are abusive, repetitive, dishonest, threatening, incomplete, or submitted in bad faith.

7.1. Changes to These Terms

The Developer may update, modify, expand, replace, or revise these Terms at any time. Updates may occur due to new features, legal requirements, platform rules, monetization changes, privacy changes, moderation changes, community features, technical changes, business needs, or other reasons.

Users may be notified through in-game prompts, legal pages, support pages, app-store updates, version notices, or other reasonable methods.

If a new version of these Terms is released, the Developer may require users to accept the updated Terms before continuing to play. If you do not accept the updated Terms, you may lose access to some or all of Nachodays.

7.2. Changes to the Game

The Developer reserves the right to modify, add, remove, restrict, rebalance, replace, reset, discontinue, rename, redesign, or otherwise change any part of Nachodays at any time, including but not limited to:

Gameplay systems;

Card rules;

Battle rules;

Gacha or reward systems;

Progression models;

Currency systems;

Champion abilities;

Prices;

Cosmetics;

Drop rates;

Ad rewards;

Premium Program features;

Online systems;

Church features;

Story content;

Events;

UI;

Music;

Assets;

Availability of platforms, regions, devices, or versions.

Such changes may occur with or without notice and may affect user expectations, strategies, rewards, progression, or access.

7.3. Sunsetting, Maintenance, and Shutdown

The Developer may suspend, discontinue, sunset, disable, remove, or shut down some or all of Nachodays, temporarily or permanently, at any time.

If Nachodays is discontinued, the Developer may make reasonable attempts to notify users in advance, but access, data, accounts, gameplay, purchases, Premium features, ads, rewards, online services, and other features may become unavailable permanently without liability, except where required by law.

7.4. No Obligation to Continue Development

Nachodays is developed by an independent creator. The Developer does not guarantee continued updates, live service support, new content, bug fixes, expansions, events, story releases, feature additions, platform ports, or long-term availability.

Development plans, roadmaps, announcements, ideas, beta notes, update notes, or future feature descriptions are not guarantees or binding commitments.

8.1. No Account Sharing

Users are strictly prohibited from sharing account credentials, login details, account access, device-linked access, platform access, or any other access rights with another person.

8.2. Device Ownership and Access Restriction

Accounts may only be accessed on devices owned or controlled by the registered user, unless the Developer explicitly allows otherwise. Lending, renting, selling, transferring, trading, or granting account access to another person may violate these Terms.

8.3. Consequences of Account Sharing

Any confirmed or reasonably suspected account sharing, unauthorized access, account selling, account trading, boosting, or account transfer may result in penalties, including temporary suspension, permanent ban, removal of rewards, reset of progression, termination without refund, or other enforcement actions.

8.4. Account Security Abuse

Users may not use shared devices, account recovery, platform sign-in, family sharing, emulator setups, cloud saves, or other systems to bypass bans, duplicate rewards, access another user’s data, or manipulate Nachodays.

9.1. Human-Only Gameplay

All gameplay actions must be performed manually by the user through the official client, unless the Developer expressly provides a feature that allows otherwise.

Automated scripts, bots, AI-driven inputs, macros, auto-clickers, farming programs, third-party controllers designed to automate gameplay, or other non-human methods of interaction are strictly forbidden.

9.2. Unauthorized Software and Tools

Use of third-party tools, cheats, modified clients, injected code, packet manipulation, memory editing, client tampering, unofficial patches, unauthorized overlays, automation programs, or programs that interact with Nachodays in ways not intended by the official client is prohibited.

This includes emulation of player actions, artificial boosting, automated reward farming, ad farming, online match manipulation, account manipulation, or exploitation of gameplay loops.

9.3. Exceptions by Written Approval

The only exceptions to this section require explicit, written, and verifiable permission directly from the sole creator and owner of Nachodays or an authorized representative. Any claim of permission must be supported by undeniable proof.

Silence, lack of enforcement, community rumors, private messages from unauthorized people, or assumptions do not constitute permission.

9.4. Enforcement

Violation of this section may result in immediate suspension, permanent account ban, removal of rewards, rollback of progress, revocation of all benefits gained through automation, device restriction, platform reports, or legal action.

10.1. Exploit Prohibition

Users may not intentionally exploit glitches, bugs, design oversights, unintended mechanics, database errors, reward errors, UI errors, store errors, advertisement errors, payment errors, online match issues, or any other unintended behavior within Nachodays.

10.2. Abuse of Systems

Any manipulation of game systems, including Gacha, rewards, progression, economy, combat, online matchmaking, Churches, chat, ads, Premium Program, account deletion, account creation, authentication, or platform systems, that provides unfair or unintended advantages will be treated as abuse.

10.3. Remedies and Corrections

If abuse is detected or reasonably suspected, the Developer may adjust the account retroactively to reflect proper outcomes. This may include removing rewards, reversing transactions, reducing balances, rolling back progress, resetting accounts, correcting ownership, deleting duplicated items, removing unfair advantages, or permanently banning accounts.

10.4. Disciplinary Action

The Developer reserves the right to impose penalties at the Developer’s sole discretion, including warnings, temporary suspensions, permanent bans, account resets, feature restrictions, data corrections, platform reports, or legal enforcement.

10.5. No Reward for Reporting After Abuse

Users who abuse an exploit and later report it are not guaranteed forgiveness, rewards, protection, compensation, or immunity. Reporting a bug does not excuse prior abuse.

11.1. Right to Modify or Remove Accounts

The Developer reserves the right to alter, restrict, suspend, correct, reset, roll back, lock, mute, ban, or permanently delete any account data if required to address critical issues, violations, fraud, bugs, security concerns, legal obligations, platform requirements, abuse, or threats to the Game environment.

11.2. No Prior Warning Required

While the Developer may attempt to address issues through ordinary processes, the Developer may act without prior warning if immediate action is necessary to protect the Game, its community, its systems, its economy, its legal position, its platform standing, or its stability.

11.3. Non-Liability

The Developer is not liable for any loss of access, account data, currency, progression, Virtual Items, Premium benefits, social features, Church membership, messages, posts, or other content resulting from an account shutdown, moderation action, correction, restriction, deletion, or enforcement action under these Terms.

Users accept these risks as part of continued use of Nachodays.

12.1. Social Features and Churches

Nachodays may include limited social features, including but not limited to player groups referred to in-game as “Churches,” Church chats, Church announcements, Church message boards, Church leadership tools, and related community features.

For purposes of these Terms, the word “Church” refers only to an in-game player group, club, fellowship, guild, or community feature within Nachodays. It does not refer to any real-world religious institution, real-world church, religious organization, denomination, or legally recognized religious body.

Social features in Nachodays are intentionally limited. Nachodays does not guarantee global chat, public lobby chat, direct messaging, private messaging, or unrestricted player-to-player communication. The Developer may choose to provide communication only through Church-based systems or other limited in-game features.

12.2. Church Chat and Message Board Rules

Users may only use Church chats, Church message boards, or any other social feature in a respectful, lawful, age-appropriate, and game-appropriate manner.

Users may not use any social feature to post, transmit, encourage, request, promote, or share content that includes, encourages, or involves:

Harassment, bullying, threats, intimidation, or targeted abuse;

Hate speech, slurs, discriminatory content, or attacks against protected or personal characteristics;

Sexual content, grooming behavior, predatory behavior, or attempts to solicit personal information from minors or other users;

Graphic violence, real-world threats, self-harm encouragement, or dangerous instructions;

Spam, scams, phishing, fraud, impersonation, or deceptive behavior;

Attempts to share personal contact information, private information, addresses, phone numbers, passwords, login credentials, or other sensitive information;

Links, advertisements, external promotions, or attempts to redirect users outside the Game without permission;

Excessive repetition, disruptive posting, flooding, or attempts to overload or abuse the chat system;

Content that violates these Terms, platform rules, applicable law, or the intended spirit of Nachodays.

The Developer may restrict social features by cooldown timers, character limits, allowed-character systems, message filters, account age requirements, Church role permissions, moderation tools, automated systems, or manual review.

12.3. No Expectation of Unrestricted Speech

Nachodays is a privately operated game and online service. Users do not have an unrestricted right to speak, post, advertise, argue, organize, or distribute content through Nachodays.

The Developer may remove, restrict, hide, block, filter, reject, mute, delete, preserve, review, or otherwise moderate any message, post, username, Church name, Church description, Church announcement, or other user-submitted content at the Developer’s sole discretion.

The Developer may moderate content for any reason, including but not limited to safety, game integrity, legal compliance, community standards, platform rules, user reports, suspected misconduct, or the protection of Nachodays and its users.

12.4. User Content License

By submitting, posting, sending, naming, uploading, entering, or otherwise providing any text or content through Nachodays, including usernames, Church names, Church messages, Church announcements, reports, or other in-game submissions, you grant the Developer a worldwide, royalty-free, non-exclusive, sublicensable, transferable, revocable-by-removal, and perpetual license to host, store, copy, display, transmit, process, moderate, delete, preserve, review, and use that content as reasonably necessary to operate, protect, moderate, improve, update, enforce, and provide Nachodays.

This license does not give users ownership over Nachodays, its systems, its characters, its world, its assets, or its intellectual property. User-submitted content may be removed at any time and may not be recoverable.

12.5. Moderation Powers

The Developer reserves the right to enforce these Terms through any moderation action deemed necessary, including but not limited to:

Warning a user;

Deleting or hiding messages, posts, usernames, Church names, or other content;

Restricting access to Church features;

Muting a user temporarily or permanently;

Removing a user from a Church;

Restricting a user from creating, joining, leading, or posting in Churches;

Suspending a user account;

Permanently banning a user account;

Resetting, modifying, or removing account data, rewards, currency, items, progress, or privileges connected to misconduct;

Blocking access to specific features, devices, accounts, or services;

Reporting misconduct to platform providers, hosting providers, payment processors, law enforcement, legal counsel, or other appropriate parties where necessary.

Moderation actions may be taken with or without prior notice. The Developer is not required to provide warnings, explanations, appeal rights, evidence, or advance notice before taking moderation action.

12.6. Chat Muting and Communication Restrictions

The Developer may temporarily or permanently mute, silence, restrict, or limit a user’s ability to communicate through Church chats, message boards, announcements, usernames, or other social features.

A chat mute or communication restriction may apply to one Church, multiple Churches, all social features, or the entire account. Mutes may be issued for rule violations, suspected abuse, spam, disruptive behavior, safety concerns, repeated reports, or any other reason the Developer considers necessary to protect Nachodays or its users.

Users may not bypass a mute, ban, or restriction by creating another account, using another device, accessing another user’s account, changing names, manipulating data, or otherwise attempting to evade enforcement.

12.7. Church Leadership and Responsibility

Church owners, leaders, co-leaders, moderators, or similar in-game roles may receive limited tools to manage their Church. These tools may include removing members, managing posts, moderating messages, setting Church rules, posting announcements, or limiting participation.

Church leaders are expected to use these tools fairly and responsibly. Abuse of Church leadership tools, including harassment, scams, threats, exclusionary abuse, impersonation, false moderation, or manipulation of members, may result in loss of Church leadership, Church deletion, account penalties, or other enforcement actions.

The Developer is not responsible for disputes between Church members, Church leaders, or users. The Developer may intervene in Church disputes at the Developer’s sole discretion but is not obligated to do so.

12.8. Reports and Investigations

Users may be allowed to report messages, users, Churches, posts, names, or other content. Reports do not guarantee that action will be taken.

The Developer may review reports manually, automatically, or through third-party systems. The Developer may consider message history, account history, device or account signals, user reports, automated filters, platform notices, or other available information when investigating misconduct.

Users may not knowingly submit false, malicious, abusive, spammed, or bad-faith reports. Abuse of the report system may result in account penalties.

12.9. Preservation of Evidence and Severe Misconduct

In severe cases, the Developer may preserve relevant records, including account identifiers, message content, reports, moderation history, transaction history, access logs, device-related signals, or other information reasonably necessary to investigate, enforce, defend, or comply with legal, safety, or platform obligations, subject to applicable law and the Privacy Policy.

Severe misconduct may include, but is not limited to:

Threats of real-world violence;

Harassment campaigns;

Predatory conduct;

Attempts to exploit, groom, or endanger minors;

Fraud, scams, chargeback abuse, or payment abuse;

Unauthorized access, hacking, database abuse, API abuse, or attacks on Nachodays systems;

Distribution of malware, phishing attempts, or credential theft;

Impersonation of the Developer, moderators, platform staff, or other users;

Commercial misuse, theft, scraping, extraction, or redistribution of Nachodays content;

Any conduct that may violate applicable law.

In such cases, the Developer reserves the right to take any action deemed necessary, including account termination, feature restrictions, preservation of evidence, legal notices, takedown requests, reports to platform providers, reports to service providers, and, where appropriate, referral to law enforcement or legal counsel.

12.10. Legal Enforcement

The Developer reserves the right to pursue legal remedies where user conduct causes or threatens to cause harm to Nachodays, the Developer, other users, the Game’s systems, the Game’s intellectual property, the Game’s reputation, or the security and integrity of the service.

Legal action may be considered in cases involving hacking, unauthorized access, theft of assets, redistribution, commercial misuse, impersonation, harassment, threats, fraud, scraping, AI/data misuse, reverse engineering, payment abuse, or any other serious violation of these Terms or applicable law.

Nothing in these Terms limits the Developer’s right to seek injunctive relief, damages, takedowns, platform enforcement, account termination, preservation of evidence, or any other remedy available under law.

13.1. Premium Program and Subscription-Based Features

Nachodays may offer an optional paid Premium Program, subscription, membership, pass, or similar paid feature. Unless otherwise stated in-game or by the applicable platform, the planned Premium Program may be offered approximately once every thirty days for a listed price such as $9.99 USD plus applicable taxes, fees, or platform charges.

The Premium Program may provide access to benefits, rewards, boosts, timers, convenience features, ad-related alternatives, or other features that would otherwise require advertisement viewing, gameplay activity, or other in-game actions.

The exact price, benefits, duration, availability, renewal behavior, and included features may change at any time. The Developer does not guarantee that any specific Premium Program benefit will remain available permanently.

13.2. Platform Billing and Taxes

All payments, subscriptions, renewals, taxes, cancellations, refunds, billing disputes, and payment processing may be handled by the applicable platform provider, including Apple, Google, or any other authorized storefront or payment processor.

Users are responsible for reviewing the purchase confirmation screen, subscription terms, renewal terms, price, taxes, and cancellation instructions provided by the applicable platform before completing a purchase.

Taxes, platform fees, currency conversion, regional pricing differences, and payment processing rules may vary by location and platform.

13.3. Subscription Renewal and Cancellation

If the Premium Program is offered as a recurring subscription, it may automatically renew unless canceled according to the rules of the applicable platform or payment provider.

The Developer may not be able to cancel a user’s subscription directly if the subscription is managed by Apple, Google, or another third-party platform. Users are responsible for managing and canceling subscriptions through the platform account, app store settings, or payment system used to purchase the subscription.

Uninstalling Nachodays, deleting an account, abandoning an account, losing access to an account, or stopping gameplay does not automatically cancel a subscription unless the applicable platform specifically provides otherwise.

13.4. No Cash Value and No Ownership of Premium Benefits

Premium Program benefits, virtual currency, boosts, rewards, ad-skip features, ad-replacement features, access privileges, cosmetics, items, titles, Champions, or other paid or unpaid benefits do not have real-world monetary value.

Users do not own any Premium Program benefits or virtual items. Users receive only a limited, revocable, non-transferable, non-sublicensable license to access applicable benefits within Nachodays while those benefits are available and while the user remains eligible.

Premium benefits may not be sold, traded, transferred, gifted, exchanged, rented, redeemed for cash, or used outside Nachodays unless the Developer explicitly provides written permission or an official in-game feature allowing it.

13.5. Changes to Premium Features

The Developer may modify, rebalance, replace, limit, suspend, remove, or discontinue any Premium Program feature, advertisement-related feature, reward, boost, item, timer, price, duration, or benefit at any time, subject to applicable law and platform rules.

Such changes may be made for balance, fairness, technical limitations, legal compliance, platform requirements, monetization changes, business needs, abuse prevention, service changes, or any other reason deemed necessary by the Developer.

13.6. Refunds for Premium Features

Except where required by applicable law or platform policy, purchases and subscriptions are final and non-refundable.

Refund requests may need to be handled through the platform provider used for the purchase, such as Apple App Store, Google Play, or another authorized storefront. The Developer does not guarantee refunds, credits, replacement benefits, compensation, or reimbursement for unused time, lost access, account bans, account deletion, feature changes, discontinued features, accidental purchases, or user dissatisfaction.

If an account is suspended, banned, deleted, restricted, or terminated due to violation of these Terms, the user is not entitled to a refund, credit, replacement, or compensation except where required by law or platform policy.

13.7. Advertisements and Rewarded Ads

Nachodays may include advertisements, rewarded advertisements, interstitial advertisements, optional advertisement viewing, third-party ad network integrations, or other ad-supported features.

Advertisements may be provided by third-party services, including but not limited to Google, Unity, or other advertising partners. These third-party services may collect or process certain data as described in the Privacy Policy, platform disclosures, consent prompts, or applicable privacy settings.

Advertisement availability is not guaranteed. The Developer does not guarantee that ads will always load, that rewards will always be available, that ad networks will provide suitable ads, or that a user will always be eligible to receive advertisement-based rewards.

13.8. Advertisement-Based Rewards and Boosts

Nachodays may allow users to watch advertisements in exchange for in-game rewards, boosts, timers, currency, convenience features, or other benefits.

Advertisement-based rewards may be subject to limits, cooldowns, daily caps, regional availability, ad network availability, anti-fraud checks, age restrictions, platform rules, and technical conditions.

The Developer may deny, reverse, remove, limit, reduce, or modify advertisement-based rewards if the Developer believes there was fraud, automation, exploitation, repeated failed ad completions, network manipulation, platform abuse, reward duplication, or unintended behavior.

13.9. No Guarantee of Ad-Free Experience

Unless explicitly stated as part of an active Premium Program benefit or other official feature, Nachodays does not guarantee an ad-free experience.

Even if a Premium Program or paid feature reduces, replaces, disables, or bypasses certain advertisements, some messages, platform notices, sponsorship notices, service announcements, legal prompts, optional reward systems, or non-advertisement communications may still appear.

13.10. Third-Party Advertisement Content

The Developer may not fully control the specific content, timing, targeting, availability, or technical delivery of third-party advertisements. Advertisement content is generally provided by third-party ad networks or platform services.

The Developer is not responsible for third-party advertisement content, third-party websites, third-party offers, third-party services, or any actions users take after interacting with an advertisement, except where required by applicable law.

Users should use caution when interacting with advertisements, external links, offers, or third-party content.

13.11. Monetization Abuse

Users may not exploit, automate, manipulate, fake, spoof, or abuse any advertisement, subscription, Premium Program, reward, currency, boost, purchase, refund, receipt, or monetization system.

Prohibited monetization abuse includes, but is not limited to:

Using bots, macros, scripts, modified clients, automation, or emulators to farm rewards;

Manipulating ad completion signals;

Spoofing purchases, receipts, subscriptions, or platform responses;

Abusing chargebacks, refunds, or payment disputes;

Attempting to obtain paid benefits without payment;

Sharing paid account access;

Exploiting bugs to duplicate rewards, extend subscriptions, bypass ads, bypass timers, or gain unauthorized benefits;

Using unauthorized tools to interfere with ad networks, payment providers, or platform services.

Violation of this section may result in removal of rewards, rollback of benefits, account suspension, permanent ban, report to platform services, legal action, or any other enforcement action deemed necessary.

14.1. Beta Builds, Testing Builds, and Open Testing

Nachodays may be made available through beta builds, testing builds, open testing, limited testing, TestFlight, Google Play testing tracks, itch.io, direct downloads, or other pre-release distribution methods.

Testing builds may be incomplete, unstable, unpolished, unbalanced, temporary, experimental, or subject to data resets. Features in testing builds may not appear in final releases.

14.2. No Guarantee of Progress Preservation During Testing

During beta testing, open testing, or other pre-release periods, the Developer may reset, delete, modify, rebalance, or migrate user accounts, progress, items, currency, rewards, Churches, match data, or other information.

Users are not entitled to compensation, refunds, replacement items, special rewards, or damages due to testing resets, bugs, changed features, removed content, discontinued testing periods, or unavailable builds.

14.3. Testing Feedback

If you provide feedback, bug reports, ideas, suggestions, balance opinions, feature requests, artwork ideas, music ideas, story ideas, design ideas, or other submissions to the Developer, you grant the Developer a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, modify, implement, ignore, publish, adapt, or commercialize that feedback in connection with Nachodays or related projects without compensation, credit, approval, or obligation.

You agree not to submit confidential, proprietary, stolen, illegal, or third-party-owned ideas or materials.

15.1. Platform Rules

Your use of Nachodays may also be governed by rules, terms, policies, and agreements from Apple, Google, itch.io, Firebase, Unity, ad networks, payment processors, device manufacturers, internet providers, or other third-party platforms and services.

You are responsible for complying with all applicable platform rules. If there is a conflict between these Terms and mandatory platform requirements, the platform requirements may apply to the extent required.

15.2. App Store and Platform Enforcement

The Developer may report misconduct, fraud, payment abuse, security concerns, or policy violations to platform providers. Platform providers may take their own actions, including refunds, purchase restrictions, account restrictions, app removal, review actions, or other enforcement.

The Developer is not responsible for platform decisions, store review outcomes, platform delays, rejected builds, removed listings, unavailable regions, payment processing issues, or platform account actions.

16.1. Third-Party Services

Nachodays may depend on third-party services such as Firebase, Google Cloud, Google Play, Apple services, Unity services, advertisement providers, analytics services, crash-reporting systems, hosting providers, or other technical services.

The Developer does not fully control these third-party services and is not responsible for outages, changes, data processing, policy changes, pricing changes, availability limits, regional restrictions, account restrictions, or technical issues caused by third-party services.

16.2. External Links

Nachodays, its website, ads, support pages, or legal pages may contain links to third-party websites, services, stores, documents, or resources. The Developer is not responsible for third-party websites, policies, content, security, accuracy, availability, or actions.

Users access third-party links at their own risk.

F.1. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Tennessee, United States, without regard to conflict of law principles, except where applicable consumer protection laws require otherwise.

If a court or authority determines that another jurisdiction’s law must apply to a specific claim, these Terms remain enforceable to the maximum extent permitted by law.

F.2. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part shall be limited, modified, or removed only to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

F.3. Entire Agreement

These Terms, together with the Privacy Policy, Community Rules, in-game notices, platform notices, and any additional terms presented for specific features, constitute the entire agreement between you and the Developer regarding Nachodays and supersede any prior agreements, discussions, statements, or understandings, whether written or oral.

F.4. No Waiver

Failure by the Developer to enforce any part of these Terms does not constitute a waiver of that right or provision. Any waiver must be explicit and in writing to be effective.

F.5. Assignment

You may not assign, transfer, sell, delegate, or sublicense your rights or obligations under these Terms without written permission from the Developer.

The Developer may assign or transfer these Terms, the Game, its rights, obligations, assets, services, or business operations to another person or entity in connection with a sale, transfer, restructuring, partnership, legal requirement, or other lawful purpose.

F.6. Survival

Sections relating to intellectual property, prohibited uses, virtual items, account termination, moderation, user content licenses, legal enforcement, disclaimers, limitation of liability, payment terms, advertisements, AI/data restrictions, governing law, severability, no waiver, and any other provisions that by their nature should survive termination shall survive any termination, deletion, discontinuation, or loss of access.
